1. Agreement to Terms

Welcome to M4 Suite. These Terms of Service ("Terms") govern your access to and use of the M4 Suite platform, website (www.m4suite.com), and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Account Registration and Security

3. Use of Service

M4 Suite provides marketing automation and business management tools for trades, home services, real estate, hard money lending, and pet services industries. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree NOT to:

• Use the Service in any way that violates any applicable law or regulation
• Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use the Service to transmit malware, viruses, or harmful code
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete with M4 Suite or develop competing products

4. Subscription and Payment

M4 Suite offers various subscription plans with different features and pricing. By subscribing, you agree to pay all fees associated with your selected plan.

• Subscriptions are billed on a recurring basis (monthly or annually)
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• You authorize us to charge your payment method on file
• Failure to pay may result in suspension or termination of your account

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by M4 Suite LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create or upload to the Service. By using the Service, you grant us a limited license to use, store, and process your content to provide the Service.

6. How We Use Your Information

We use the information we collect to respond to your inquiries, provide customer service, send text messages you have opted into (including service-related and promotional communications), improve our website and services, and comply with applicable legal obligations.

7. SMS / Text Messaging

By opting in to receive SMS messages from M4 Suite LLC, you consent to receive text messages at the phone number you provide. Message frequency varies. Message and data rates may apply.

To opt out: Reply STOP to any text message at any time. You will receive a single confirmation and no further messages will be sent unless you opt back in.

7.1 Explicit Opt-In & Re-join Clause

By opting in to receive SMS/text messages from M4 Suite LLC at the phone number you provide, you explicitly consent to receive recurring transactional and promotional text messages. This is a written agreement between you and M4 Suite LLC. You understand that message frequency may vary and that standard message and data rates applied by your mobile service provider will apply.

If you previously opted out by texting STOP, you may re-join our SMS program by texting START or by re-opting in through your account settings. Upon re-joining, you will again consent to receive SMS messages from M4 Suite LLC according to these terms.

7.2 Exact STOP Keyword Workflow

To immediately stop receiving SMS messages from M4 Suite LLC, reply STOP to any message you receive. You will receive a final confirmation message confirming your unsubscribe. After this confirmation, no further messages will be sent to your mobile phone from M4 Suite LLC unless you re-opt in. The STOP command is the only method required to opt out. You will not be charged additional rates for opting out.

7.3 Keywords: HELP & STOP

STOP Keyword: To unsubscribe from all SMS messages, reply STOP to any text message at any time. You will receive one final confirmation message, and no further text messages will be sent.

HELP Keyword: To receive help or more information about our SMS program, reply HELP to any text message. You will receive information on how to manage your preferences and how to contact us.

8. Information Sharing (Updated)

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Carrier Liability (Updated)

Carriers are not liable for delayed or undelivered messages.

10. Message Frequency & Rates (Updated)

Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interactions and preferences. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

11. Intellectual Property Content

All content on this website, including text, graphics, logos, and images, is the property of M4 Suite LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. User Content and Data

You are solely responsible for the content you create, upload, or transmit through the Service. You represent and warrant that:

• You own or have the necessary rights to use and share your content
• Your content does not violate any third-party rights
• Your content complies with applicable laws and these Terms
• Your marketing activities comply with applicable advertising and privacy laws

13. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to the Service until the end of your current billing period.

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in conduct that we determine, in our sole discretion, to be inappropriate or harmful to the Service or other users.

14. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

M4 Suite does not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for delays, delivery failures, or damage resulting from your use of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, M4 SUITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

15. Indemnification

You agree to indemnify, defend, and hold harmless M4 Suite, M4 Suite LLC, and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your content, or your violation of these Terms.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property rights.
